1.
The Promoter of
this competition is Mimco Pty Ltd ACN 067 573 291 of 111 Cambridge Street,
Collingwood VIC 3066.
2.
Instructions on
"How to Enter" form part of these terms and conditions. Participation by each entrant in this Dreamwarp
Style Society competition is deemed to be acceptance of these terms and
conditions.
3.
The competition
is open to aspiring stylists over the age of 18 years, except employees of the
Promoter, their immediate families and any other agency determined by the
Promoter at its discretion to be associated with this promotion. For the
purposes of this clause 3, "immediate families" of an employee of the
Promoter includes his or her spouse, ex-spouse, de facto spouse, child, step
child, adopted child, parent, step-parent, grandparent, uncle, aunt, siblings,
step-siblings, or first cousin.
4.
Competition
commences at 9:00am AEST on February 2, 2012. Public voting commences at 9:00am
AEST on March 7, 2012 and closes at 5:00pm AEST on March 29th, 2012. Entries received outside of this period
will not be accepted by the Promoter.
5.
Entries to the
Dreamwarp Style Society competition must upload their image entry to www.dreamwarpsociety.com.au in
jpeg format, at a minimum of 300 dpi. Limit of one entry per person. The image
submission must include a person (model) and fashion products that capture
their interpretation of one or all of the stories outlined in the Dreamwarp Style
Society campaign.

7.
The Promoter
reserves the right, at any time, to verify the validity of entries and entrants
including an entrant's identity, age, and place of residence and to disqualify
any entrant who submits an entry that is not in accordance with these terms and
conditions or who tampers with the entry process. Despite anything to the
contrary in these terms and conditions, errors and omissions may be accepted at
the Promoter's complete discretion. Failure by the Promoters to enforce any of
its rights at any stage does not constitute a waiver of those rights.
8.
Each entry will
be individually judged based on creative merit and originality. The judges'
decision in relation to all aspects of this promotion is at their complete
discretion and final and binding on all persons who enter into this competition
and no correspondence will be entered into.
9.
This promotion is
a game of skill and chance plays no part in determining the finalist/winner.
10.
Judging the
overall winner will begin on or about March 30th, 2012 with the
winner being chosen by April 11th, 2012. This promotion will be
judged by a panel of judges appointed by the Promoter. The winner will be
notified by email using contact details provided in their entry and/ or posted on
the Promoter’s website. If the
winner cannot be contacted within a reasonable amount of time (which must be no
less than 7 days of being judged as the successful entrant) the judges may
appoint a new winner.
11. There will be five minor prizes awarded to the top
five entrants with the most public votes at the close of the competition. Each
of the top five will receive $1,000 AUD loaded onto their Mimcollective Loyalty
Card. In the event the winner does not have a Mimcollective Loyalty Card, one
will be issued to them. Upon activation via in-store or online, the minor prize
money will be awarded approximately 24 to 48 hours post activation.
12.
The major prize
winner will be determined by the panel of judges, from the top five entrants,
as voted by the public at the close of the competition. The winner will act as
an Assistant Stylist on the upcoming Mimco campaign shoot and will be
transferred to the nominated destination from their nearest capital city,
including economy flights, transfers, meals and accommodation as required. The
duration of stay will be determined based on the requirements of the shoot,
however will range between one and three nights.
13.
Total major prize
value is estimated to be approximately $2,000.00 AUD. This figure will be
dependent on the location of the Mimco campaign shoot.
14.
Total minor
prizes value is $5,000 AUD.
15.
The winner is
responsible for additional spending money and other ancillary costs not specifically
included as part of the major prize package which includes, but is not limited
to, insurance and any applicable insurance excesses.
16.
If for any reason
whatsoever the winner does not take all components of the major prize package
then that component of the major prize package not taken will be forfeited by
the winner and cash will not be awarded in lieu of the forfeited component.
17.
The prize must be
taken as offered. The prize, or any unused portion of the prize, is not
transferable or exchangeable and cannot be redeemed as cash, unless otherwise
specified. The vouchers are valid in the currency of the country in which they
are issued. The Promoter accepts no responsibility for any variation in the
prize's value. The winner is advised that tax implications may arise from their
prize winnings and they should seek independent financial and tax advice prior
to acceptance of their prize.
18.
If any prize is
unavailable, the Promoter, in its complete discretion, reserves the right to
substitute the prize with a prize to the equal value and/or specification.
19.
It is a condition
of accepting the prize that the winner may be required to sign a legal release
document and/or other documents of consent in respect of the prize. These
documents will be provided in a form to be determined by the Promoter.
20.
In the event that
for any reason whatsoever the winner does not take all elements of the prize at
the time stipulated by the Promoter under clause 16, then that element of the
prize will be forfeited by the winner and cash will not be awarded in lieu of
that element of the prize.
21.
The promoter
accepts no responsibility for any variation in the value of the major prize
package.
22.
If this promotion
is interfered with in any way or is not capable of being conducted as
reasonably anticipated due to any reason beyond the reasonable control of the
Promoter, the Promoter reserves the right, in its sole discretion, to the
fullest extent permitted by law (a) to disqualify any entrant; or (b) to
modify, suspend, terminate or cancel the promotion, as appropriate.
23.
Except for any
liability that cannot be excluded by law, the Promoter (including its officers,
employees, agents and related bodies corporate) is not liable for, and each
entrant must not bring any claim for, any personal injury, or any loss or
damage whatsoever (including loss of opportunity), whether direct, indirect,
special or consequential, arising in any way out of this competition, including, but not
limited to, where arising out of any of the following: (a) any negligence of
the Promoter (including its officers, employees, agents and related bodies
corporate); (b) technical difficulties or equipment malfunction (whether or not
under the Promoter control); (c) any theft, unauthorised access or third party
interference; (d) any entry or prize claim that is late, lost, altered, damaged
or misdirected (whether or not after their receipt by the Promoter) due to any
reason beyond the reasonable control of the Promoter; (e) any variation in the
prize value to that stated in these terms and conditions; (f) any tax liability
incurred by the winner; and (g) redemption or taking of the prizes. In this clause 19, "related bodies
corporate" has the same meaning as is given to that term in the
Corporations Act 2001 (Cth).
24.
The Promoter reserves
the right in its sole discretion and to the extent permitted by law to amend
any aspect of this Dreamwarp Style Society competition at any time (including
these terms and conditions) without prior notification.
25.
All entries
submitted (including any rights to the intellectual property contained in such
entries) are assigned to, and become the property of, the Promoter. By entering
this promotion each entrant warrants to the Promoters that each entry submitted
is an original literary work of the entrant, has not been previously published
or won any award, and does not contain any material which would infringe the
rights of any third party, including any copyright, trademark or other third
party intellectual property rights. The entrant agrees to indemnify the
Promoter, and keep the Promoter indemnified, against all claims and costs by
third parties arising from a breach of the warranty set out in this clause. The
Promoter is entitled to use any of the entries submitted for any purposes at
its discretion, including (but not limited to) for any future promotion,
marketing and publicity purposes.
26.
By entering the
competition, the entrant consents to receipt of any email regarding the
competition, content on Facebook and other emails which inform the entrant of
the Promoter other publications, products, services and events and to promote
third party goods and services it may be interested in.
27.
The collection,
use and disclosure of personal information provided in connection with this competition

28.
These terms and
conditions are governed by, and are to be construed in accordance with, the
laws enforceable in Victoria, Australia.
Each party submits to the non-exclusive jurisdiction of the courts
exercising jurisdiction in Victoria, Australia and any court hearing appeals
from those courts.
29.
These terms and
conditions embody the entire agreement between the Promoter and each entrant
with respect to this competition.
30.
Any provision in
these terms and conditions which is invalid or unenforceable in any
jurisdiction is to be read down for the purpose of that jurisdiction, if
possible, so as to be valid and enforceable, and otherwise must be severed to
the extent of the invalidity or unenforceability, without affecting the
remaining provisions of these terms and conditions or affecting the validity or
enforceability of that provision in any
other jurisdiction.
